A few days prior to July 20, 2023, Plaintiff made a police report that Mr. Tucker spray painted and defaced Plaintiff's automobile. On approximately July 8, 2023, Plaintiff reported to the Human Resources Administration that his benefit card was stolen. Mr. Tucker stole the card information and used the balance without Plaintiff's knowledge or permission. On July 20, 2023, at about 11 PM, Mr. Tucker assaulted Plaintiff outside his home. He ran toward and lunged at Plaintiff, repeatedly threatening to kill him. Plaintiff fell over backwards trying to escape Mr. Tucker's assault and was struck multiple times before eventually managing to call the police. NYPD officers handcuffed and arrested Plaintiff upon arrival. Without any legal justification, they entered Plaintiff's home, destroyed his minor son's toys, and ripped down art from the wall. Plaintiff was injured and requested medical attention multiple times but was ignored by the officers. When EMTs later arrived at the precinct, defendant officers prevented them from treating Plaintiff's injuries for hours. Plaintiff was finally taken to the hospital hours later. \n\nPlaintiff appeared before a judge on or about July 22, 2023. Unable to afford bail, he was remanded until July 26, 2023 when all charges against him were dismissed and sealed. While in custody, he was forced to take unnecessary medication that dangerously lowered his heart rate, causing him to consistently lose consciousness. P.O. asked her youngest daughter’s father. When the Plaintiff informed that he was not at home, P.O. arrested the Plaintiff without probable cause and ransacked her home. After hours of illegally searching Plaintiff’s home, P.O. grabbed Plaintiff, pinned her arms behind her back, and shackled her wrists with tight, metal handcuffs full of her terrified and screaming children. The handcuffs were so tight on Plaintiff’s writs that Plaintiff experienced lacerations and bruising to her writs. After several hours, P.O. took the Plaintiff out of her home and to the 88th Precinct. At the Precinct, P.O. illegally searched, interrogated, photographed, and fingerprinted Plaintiff without probable cause. While at the Precinct, Plaintiff was visibly ill and began vomiting, yet P.O. offered no medical treatment. Due to P.O.’s false statement, the Kings County district attorney prosecuted them unlawfully. On December 17, 2021, the Grand Jury of Kings County voted to dismiss all charges against Plaintiff.
