Plaintiff adjusted his face shield to wipe sweat from his face while attempting to restart his motorbike and in that moment was stopped and seized by Defendant Officers Vincent Pinto, Christopher Ayau, Brian Magoolaghan, Officers Gomez, Medina, and Sanchez, and unnamed officers, who were stopped next to Plaintiff at the light. The officers claimed Plaintiff was not wearing his face shield correctly. Defendants told Plaintiff to move his bike to the side of the road and, while he was complying, accused him of trying to flee the scene.  After falsely accusing plaintiff of trying to flee, defendants rushed at him, broke his bike windshield, and began to assault the plaintiff. They used excessive force against the plaintiff, who lost consciousness and severe injuries including a stroke as a result of the defendant's assault. Plaintiff was handcuffed without cause and transported to the hospital, where he stayed handcuffed. Plaintiff was discharged three days later whereupon he was transported to a local precinct and charged with Assault in the Second Degree, Obstructing Governmental Administration in the Second Degree and  Resisting Arrest, as well as with unrelated charges of Aggravated Unlicensed Operation of a Motor Vehicle in the Second and Third Degrees. He was then taken to central booking, processed, and released. However, the defendant officers pursued the case and Plaintiff was subject to malicious prosecution. On January 13, 2016 plaintiff pled guilty to Aggravated Unlicensed Operation of a Motor Vehicle and the charges for Assault in the Second Degree, Obstructing Governmental Administration in the Second Degree and Resisting Arrest terminated in plaintiff’s favor and were dismissed in their entirety.
