PO Melo and Abdelfattah falsely accused Plaintiff of driving the wrong way, and unlawfully arrested Plaintiff. Without justification or cause, PO Melo and Abdelfattah then unlawfully searched Plaintiff and his vehicle, and confiscated Plaintiff’s vehicle. Plaintiff was then transported to a police service area and Plaintiff was denied phone calls, food and water. Hours later, Plaintiff was transported to central bookings. Due to false statements made by PO Melo and Abdelfattah about the events, Plaintiff was falsely charged with numerous crimes. PO Melo falsely testified before a Grand Jury asserting, inter alia, that he observed Plaintiff driving the wrong way. While Plaintiff was incarcerated, and due to the poor conditions of his confinement, Plaintiff became physically ill. Officers created Plaintiff’s medical problems, then delayed and denied proper treatment. On 8 July, 2022, the District Attorney dismissed the case against Plaintiff. Officers in an unmarked vehicle followed the group and singled out Mr. Smith, allegedly due to his race or other protected status. One of the officers, believed to be Lt. Martin McKinney, used vulgar language, pushed Mr. Smith, and, along with other officers, applied excessive force, causing injuries. Mr. Smith was placed in overly tight handcuffs, despite not resisting arrest.\n\nThe officers failed to intervene or provide medical attention, and Mr. Smith was falsely charged with obstructing governmental administration, resisting arrest, and disorderly conduct. Lt. McKinney made a false statement under oath, which led to these charges, while Officer Pascual Melo, the arresting officer, failed to intervene. The charges were dismissed on November 13, 2019.
