Despite the lack of a warrant, no exigent circumstances, and plaintiff not having committed any crime, defendants ignored plaintiff's protests that he was a lawful resident of the apartment, and also disregarded his keys, photo ID, and documents containing his name. The NYPD officer defendants collectively handcuffed plaintiff too tightly, forcefully dragged him from his home, and threw him face first into a police vehicle. The NYPD officer defendants falsely claimed that plaintiff had burglarized the department. Plaintiff could not make bail, was indicted for burglary, public lewdness, and criminal trespass on June 1, 2018, and was incarcerated in an NYC DOC facility for five months. While incarcerated, plaintiff was attacked by other inmates. The Bronx District Attorney's office made an application to the court on October 16, 2018, to have plaintiff immediately released on his own recognizance, and then on October 25, 2018, provided plaintiff's attorney a written Brady/Giglio disclosure that a witness informed them plaintiff was a lawful resident of his apartment. The indictment was dismissed and sealed on the Bronx DA's office's motion on February 28, 2019. At least 15 members of the NYPD grabbed him off his bike and began to question and manhandle him. They assaulted Mr. Copes using their fists, legs, batons, radio, and asp. Several supervisors on the scene failed to intervene, took part in the beating, and denied Mr. Copes medical care. The officers arrested Mr. Copes and charged him with various crimes. During the course of Mr. Copes' custody, the officers delayed medical treatment, though Mr. Copes was eventually transported to a hospital. The officers fabricated paperwork and falsified documents stating that Mr. Copes was in possession of a weapon and had resisted arrest along with committing other offenses.
