This person was not present at the time of the defendant-officers' arrivals. Defendants immediately searched plaintiff's person and handcuffed person. Plaintiff cooperated with defendant, informed defendants of his reason for being present at the residence, and provided defendants with his identification showing a separate residential address. Defendants proceeded to search the residence, alleging recovering firearms and contraband; each of these alleged items were concealed. Defendant-officers arrested plaintiff without probable cause or legal justification. Defendant-officers dragged plaintiff out of the apartment and into a common elevator, wherein they forcefully pushed plaintiff with their elbows in his back and ribs. \n\nPlaintiff was transported and processed at the 88th Precinct, wherein he was interrogated about his presence in the residence and knowledge about the alleged contraband recovered. Plaintiff cooperated with defendant-officers and submitted to a DNA sample. During this time, defendants seized plaintiff's cellular phone; defendants have not returned plaintiff's property. Defendants advocated for criminal prosecution. Plaintiff was subsequently transferred to Central Booking. Plaintiff was not arraigned until 37.5 hours after plaintiff's initial arrest. Plaintiff was unable to post bond. Plaintiff remained in New York City custody until May 21, 2020. While in custody at the Manhattan Detention Center, plaintiff was assaulted by two inmates. Present DOC staff responded by spraying the plaintiff and his assailant with chemical agents, causing burning and precipitating an asthma attack. After hours of illegally searching Plaintiff’s home, P.O. grabbed Plaintiff, pinned her arms behind her back, and shackled her wrists with tight, metal handcuffs full of her terrified and screaming children. The handcuffs were so tight on Plaintiff’s writs that Plaintiff experienced lacerations and bruising to her writs. After several hours, P.O. took the Plaintiff out of her home and to the 88th Precinct. At the Precinct, P.O. illegally searched, interrogated, photographed, and fingerprinted Plaintiff without probable cause. While at the Precinct, Plaintiff was visibly ill and began vomiting, yet P.O. offered no medical treatment. Due to P.O.’s false statement, the Kings County district attorney prosecuted them unlawfully. On December 17, 2021, the Grand Jury of Kings County voted to dismiss all charges against Plaintiff. Harrington signed a search warrant authorizing the search of 80 Clifton Place, Apartment 5H, after Officer Landi made an application to the Supreme Court of the State of New York. The affidavit alleged that Officer Landi was advised, by a confidential informant, that there were firearms and ammunition at the premises – based on this information, the Honorable William M. Harrington found probable cause to issue said warrant. On April 9, 2018, Officer Landi entered the targeted premises – no firearms or illegal contraband were found. Nonetheless, Officer Landi handcuffed Mr. Goodman and sent him to the 88th Precinct. At the 88th Precinct, Officers Dumbauld and Fierro ordered Mr. Goodman to remove his pants – Mr. Goodman asked why he was under arrest and requested information of the charges, but the two officers instead slammed Mr. Goodman’s head into his knee, causing his front tooth to fall out of his mouth.  Officers Dumbauld and Fierro held Mr. Goodman in this position for an extended period of time, causing him to be unable to breathe and substantial pain to this back. Mr. Goodman was relocated to Brooklyn Hospital where he was treated for his injuries – he was then relocated to Central Booking. While Mr. Goodman was in custody, Officer Landi wrote up paperwork stating that he recovered a pistol, a live round of ammunition, and one glass pipe containing crack, and a quantity of crack from Mr. Goodman’s bedroom. These allegations were forwarded to the Kings County District Attorney’s office. While at central booking, Mr. Goodman continued to suffer pain from the previous attack and was once again relocated to Brooklyn Hospital. On April 10, 2018, Mr. Goodman was arraigned and charged.
