The plaintiffs attempted to flee and, in doing so, Mr. Joseph sustained several severe injuries including a fractured right wrist. PO Bianca Trujillo, Visar Marku, Wilken Evangelista, and Zahir Garo arrived at the scene with the ambulance, and Officer Trujillo arrested Ms. Alvarez, despite the absence of any evidence of wrongdoing on her part and that she was clearly the victim of a crime. Ms. Alvarez was held at a local precinct, believed to be the 34th Precinct of the NYPD, for several hours before being transferred to New York County Central Booking, where doe defendants placed her in the same cell as Mr. Heyliger-Vicente, who repeatedly threatened to kill her while they were detained. Ms. Alvarez was arraigned on false charges and forced to make several court appearances before the charges were dismissed. Mr. Joseph was taken from the scene of the arrest by ambulance to Harlem Hospital, where PO Danny Shen interrupted the emergency surgery to repair Mr. Joseph’s wrist and advised the doctors treating Mr. Joseph that he was under arrest. On April 22, 2013, PO Senia Tavares entered Plaintiff’s hospital room, climbed on top of him, and forcibly handcuffed his left wrist to the hospital bed, fracturing his remaining working wrist. The next day, Mr. Joseph was taken to New York County Central Booking and arraigned on false charges.
