The murder itself occurred on August 10, 2007 outside of 221st Street and 133rd Avenue in Laurelton, Queens. Plaintiff emerged as a suspect under the detective work of NYPD detective Joseph Bey. At trial, ADA Ross brought forth two witnesses who testified that they had seen Plaintiff kill the victim. Both witnesses were under criminal proceedings for other crimes they had been accused of and potentially had motives to lie in their testimony. ADA Ross had appeared at Hilton's probation violation proceeding and Turner was promised he would only be charged with a misdemeanor instead of gun possession for which could face up to 15 years if he cooperated and provided trial testimony. During deliberations, the jury asked for the judge to tell them what the evidence was for motivation to lie and/or cooperate with the DA. The judge only gave the jury the cooperation agreement between Turner and the DA but did not mention Hilton's testimony about ADA Ross appearing at his probation violation proceeding. The jury found Plaintiff to be guilty. However, on October 27, 2015 the New York State Court of Appeals reversed Plaintiff's conviction, concluding that the judge had provided the jury a misleading response to the jury's inquiry about benefits because it omitted Hilton's testimony about ADA Ross's appearance on his behalf. On January 31, 2017, Plaintiff was fully acquitted during his retrial after having spent about nine years in jail or prison.\n\nDetective Bey is implicated in this story as during his investigation he was given different reports of the incident by both Turner and Hilton, even being aware that they at times lied to him. The following day, Martinez was apprehended and falsely claimed that plaintiff was the shooter. Plaintiff was again taken to the 104th precinct and interrogated. Defendant Lundy attempted to coerce plaintiff into signing a confession, but plaintiff refused. After hours of questioning, plaintiff ultimately complied and signed a statement falsely admitting to having participated in the shooting. As a result, plaintiff was arrested.
