Police officers then approached Plaintiff. Shortly thereafter, PO Jonathan Kupferschmidt swiped the bag from Plaintiff. An officer grabbed Plaintiff with both arms and forcefully pulled him to the ground. PO Mariusz Krala then jumped on Plaintiff’s back, punched him in the face, and stated: “We could have killed you”. PO Krala thereafter pulled Plaintiff’s left hand out from under his body and forcefully stomped on it with his foot. PO Brian Andruskiewicz, the Sergeant on the scene, also a defendant in this case, had to pull PO Krala away from Plaintiff and yell at him for his conduct. Plaintiff was arrested and brought to the hospital because of the injuries the officers had caused. Plaintiff was charged with felony weapon possession and held in lieu of bail at his arraignment. He was released eight months later. On October 30, 2013, a judge found that evidence provided by Mariusz Krala and Jonathan Kupferschmidt lacked credibility, and that the arrest had been unlawful. The police officers placed him under arrest for criminal possession of a controlled substance despite not having reasonable grounds or probable cause to do so. Subsequently, the police officers initiated criminal proceedings against Plaintiff.
