Anthony was recovering from cervical spinal fusion surgery, and was wearing a hard collar. Because she was still in her sleeping garments, Regenia's breasts and body were exposed when the NYPD entered her home. Anthony was forced out of bed, at which point Detective Wilbert Hernandez (Shield #4925) twisted his arm, exacerbating a rotator cuff tear which needed surgery. Detective Jose Cintron (Shield #4861) put his foot on top of Anthony's recently fused neck. Both Hymans attempted to warn the police officers of Anthony's medical condition, but they were ignored. At no point did the officers show Regenia a warrant. Also present at the Hyman's house were Detective Matthew Degrote (Shield #3462), Daniel Boylan (Shield #1495), Stephanie E. Cepeda (Shield #3137), and Sergeant Cecelia Luckie (Shield #4593). One neighbor estimated that there were 40 police present outside the Hyman's home.\n\nBoth Hymans were placed under arrest, though the precise charges were not made clear. While Anthony was transferred to the police van, Police Officer Luis E. Cruz (Shield #22258) found a pair of boxing gloves, told Anthony that they were unlawful, and began punching Anthony in the stomach. Officer James M. Carroll (Shield #9749) was present, but did not stop Officer Cruz.\n\nWhile the Hymans were taken to the precinct and the hospital, other NYPD officers are estimated to have remained in their home for nearly 12 hours, where they damaged furniture and removed $6000 in savings.\n\nAt the precinct, Regenia expressed concerns to Sergeant Karina D. Bonilla (Shield #1252) that her husband needed to take medication. Bonilla had water provided but not food; instead she drove the Hymans to a McDonalds on their way to Central Booking. On the way, Anthony suffered a seizure. At no point during his seizure was he unhandcuffed. The police called an ambulance, but refused to let Regenia accompany her husband to the hospital. Anthony suffered four additional seizures on the drive to the hospital. He also coded twice. He was so close to death that health providers created a case ID because Hyman was a registered organ donor. Regenia was not given any updates on her husband until she was brought to his hospital room. Ultimately, Anthony was transferred to the ICU for about seven days, and remained in a different part of the hospital for an additional two weeks. Defendants illegally stopped, searched, detained and arrested plaintiffs with excessive force. Defendant officers did not posses a lawful reason to approach the plaintiffs as they were not observed to be committing any crimes or violations of the law. Defendant officers also subjected plaintiffs to illegal strip search and cavity searches.
