Plaintiff was unlawfully handcuffed and transported to the 101st Precinct where he was searched, photographed, fingerprinted, and placed in a holding cell. Plaintiff was transported to Queens Central Booking and placed in a holding cell. Defendant officers intentionally provided the Queens DA with false information regarding their basis for arresting and prosecuting plaintiff and falsely charged plaintiff with crimes he did not commit. On August 12, 2017, after 30 hours in unlawful custody, plaintiff was arraigned in Queens Court and charged with Criminal Possession of a Controlled Substance in the Third Degree. The judge set bail, which plaintiff was unable to post, and plaintiff was remanded to Riker's Island. On August 16, 2017, the grand jury indicted plaintiff. While in custody at Rikers, plaintiff was assaulted by NYC Correction Officers and suffered physical injuries, including but not limited to pain to his ribs. On August 25, 2017, after 4 days in unlawful custody, plaintiff was able to post bail and was released from custody. Plaintiff was required to make five additional court appearances.
