Defendant approached Plaintiff and told him he was going to frisk him. During this encounter, Plaintiff’s hands were above his head, as he was instructed, and then defendant conducted the unlawful frisk and did not feel anything hard or anything he believed to be illegal. When asked why the defendants was doing the search, defendant ignored the plaintiff. Plaintiff, uncomfortable with the unlawful search, turned away from the defendant. As a result, defendants tackled the Plaintiff and pushed the front side of Plaintiff’s body into the back hood of a nearby car. Almost instantly, a shot was fired, hitting Plaintiff on the inside of his leg. Plaintiff was unlawfully arrested and handcuffed by the defendants, placed in the back of an unmarked NYPD vehicle, and transported to St. Barnabas Hospital. After an overnight stay in St. Barnabas, Plaintiff was transported against his will to the 48th Precinct, where he was processed and unlawfully placed in a holding cell, still handcuffed. While at the precinct, Defendants transported the plaintiff two (2) more times back and forth to St. Barnabas hospital for further treatment for his gunshot wound. After approximately two (2) days in custody at the 48th Precinct, the Plaintiff was transferred to Bronx County Central Bookings. While Plaintiff was in custody, the Defendants provided the DA with the false, misleading and/or incomplete information that Plaintiff committed a crime.
