Defendant NYPD officers Jerry Zender and Alicea arrested and jailed plaintiff after Cornelius claimed she was in fear for her life and safety. Plaintiff was detained for 24 or more hours until his arraignment and was then re-arrested at the 113th Precinct by Defendant Detectives Chianese and Det. Doe #1 for an alleged unrelated criminal contempt offense, at which point he was jailed for another roughly 24 or more hours. Plaintiff repeatedly attempted to inform his parole officer to report his April 1, 2013, arrest and imprisonment, but was unable to reach him. Defendant parole officers Tesera Tucker, Sharon Henry, and Dennis Void allegedly conspired with Assistant District Attorney Brendan McArdle to further imprison plaintiff. Despight allegedly false statements to a hearing officer and the Bronx County Criminal Court by defendants void, plaintiff's girlfriend, her son, and Shanice Cornelius, plaintiff was found not guilty of criminal misdemeanor assault although guilty of harassment (which could not serve as the basis for a violation and revocation of plaintiff's conditional post-release supervision). Plaintiff was imprisoned until the final parole revocation hearing on Oct. 29, 2013, in exvess of the statutory maximum term of court-imposed post-release supervision.
