In the vicinity of Fordham Road and University Avenue, they were stopped by defendant police officers, who directed the occupants to exit the car and informed them that the car was reported stolen. Plaintiff and his two friends explained to the officers that they had permission to be inside and operate the vehicle, and minutes later Piantini and the owner of the car also arrived at the scene to confirm the same. Despite knowing that plaintiff did not engage in unlawful behaviors, defendant officer Martinez handcuffed and arrested plaintiff and his two friends. Plaintiff was transported to the 40th precinct, where he was searched and confined in a holding cell. The officers persisted the arrest despite Piantini and the car owner informing them again at the precinct that plaintiff had permission to be inside of and operate the vehicle.
