In May 2020, during the pandemic, the plaintiff engaged in twitter exchanges with the NYC Health Commissioner, Oxiris Barbot, as Barbot's tweet(s) expressed a lack of care or protection for NYPD officers, leading to Barbot's public apology to NYPD for her remarks. Also in May 2020, the plaintiff tweeted about and addressed public concerns about then-Mayor de Blasio's failure to adequately equip NYPD officers to respond to violent protests that took place in that month. In September 2020, the plaintiff also responded/exchanged twitter with the NYC councilman Richard Torres and Brooklyn Borough President Eric Adams about a call for an independent investigation into an alleged slowdown in police responses to shootings, and the plaintiff had to appear repeatedly for meetings where he was interrogated regarding union activity on the SBA Twitter account. In February 2021, the NYPD filed departmental disciplinary charges against the plaintiff that alleged a number of violations with Patrol Guide that could leave to removal of him as the SBA president. When Plaintiff did not comply Veneziano threatened Plaintiff with retaliation in December 2011 with discipline and failure to issue complaint reports. In or around November 2012, a felony complaint for grand larceny was written up due to a stolen granite countertop worth $3000 but Veneziano did not allow the report to be entered. In December 2012, after a citizen came to the 122nd precinct to obtain a record for stolen power tools but when Plaintiff tried to prepare a report Veneziano issued him a command discipline. In January 2013 Veneziano ordered Plaintiff to downgrade a class C felony burglary, Plaintiff refused, and the report was taken by Sergeant Urbina as a petit larceny. On or about February 27, 2013, Plaintiff contacted IAB, stating that he had reason to believe that Veneziano was destroying complaint reports, changing complaint reports, or failing to take and enter complaint reports. Plaintiff faced retaliation in response including being labeled as absent, Veneziano informed officers at the 122nd precinct of the existence of the investigation, and Veneziano lowered Plaintiff's annual evaluation in April 2013.
