PO Kyle Divirglio and/or PO Alejandro Alvarez exited their car, immediately began to curse at Plaintiff, and demanded his identification. Plaintiff provided it and one of them took the identification to a nearby restaurant. Neither officer went to their vehicle to confirm Plaintiff's identification. When Plaintiff asked why he was being detained PO Alvarez ordered Plaintiff out of his vehicle, and when Plaintiff asked again PO Alvarez attempted to remove Plaintiff from his car by pulling on Plaintiff's dreadlocks. Plaintiff was then pepper sprayed, dragged out of his vehicle, handcuffed, and thrown in a police car. Plaintiff, whose eyes and face were burning, started to kick the door of the police car. Plaintiff was then taken out of the car and slammed to the ground with a knee in his back and his head forcibly held on the concrete. Plaintiff was taken to the hospital and was ultimately in custody for approximately 24 hours before his arraignment. Plaintiff was maliciously prosecuted for Obstructing Governmental Administration and the charge was dismissed on October 26, 2017. Sgt. Ronald Reynolds, PO John Doe, and PO Joe Doe are also named Defendants.
