Plaintiff complied but despite his compliance PO Brian McGinn began falsely arresting Plaintiff, and was assisted by PO Vargas and other officers. Specifically, POs grabbed him, tripped him, forced him to the ground, struck him, and placed excessively tight handcuffs on Plaintiff. Plaintiff was not told what he was being arrested for but complied with all orders. Plaintiff was taken to the 7th Precinct where he was searched in intimate areas, causing embarrassment and humiliation. Plaintiff repeatedly fainted while in custody but was denied his requests for medical attention while he was in transport. Plaintiff was charged with Resisting Arrest and was unlawfully detained for approximately 12 - 14.5 hours, including at a hospital, before being released. POs intentionally forwarded false information to initiate a malicious prosecution but the District Attorney declined to prosecute. The officers falsely claimed there was no license plate on the back of the car, despite the plaintiff having affixed a temporary plate to the back window. The plaintiff offered to call the seller to address the officers' concerns, but they refused and demanded he step out of the car before immediately arresting him. The plaintiff was not informed of the basis for his arrest until much later, when the officers stated they believed the temporary plate was fraudulent. The plaintiff pleaded with the officers to allow him to contact the previous owner or have a friend pick him up, explaining he had no knowledge of the plate's origins, but was refused. Officer Weisenburger then pushed the plaintiff's legs into the patrol car, closed the door in his face, and threatened him. At the precinct, the plaintiff continued to protest his unnecessary arrest. Defendant Sergeant Miele lied, claiming the plaintiff was brought to the precinct for the Sergeant's convenience and that he would be allowed to call the seller and then be released. Instead, the plaintiff was falsely charged with one felony, two misdemeanors, two violations, and three infractions. He was held at the precinct for more than 24 hours before being taken to see a judge. All charges were dismissed in the plaintiff's favor on July 16, 2021.
