Plaintiff was standing outside a nightclub when the defendants began to question plaintiff in a harassing manner.  Plaintiff feared for his safety and tried to leave the area since he was not told he was under arrest.  Defendants pursued him and even after he stopped, struck him with their police vehicle, knocking him to the ground and seriously injuring his left knee, right shoulder and lower back.  The defendants began to restrain the plaintiff with unreasonably tight metal handcuffs.  They searched him before forcefully lifting him up and thus causing further pain.  Plaintiff was then transported to a precinct.  There, he was again searched, fingerprinted, photographed and placed in a cell.  Finally, as a result of his pleas for medical attention for the excruciating pain from being struck with the vehicle, plaintiff was transported to a local emergency room.  Thereafter, plaintiff was transported to Central Booking, where he was again processed and detained in a holding cell.  While Plaintiff was in custody, the defendant police officers provided the New York County DA’s Office with the false, misleading, and/or incomplete information that Plaintiff had committed a crime, which declined to prosecute the plaintiff.  Plaintiff was then released.
