Immediately prior to his arrest, Berry noticed Transit employees Herer and John Doe #1-3 yelling profanities along with calling for officers to arrest Berry. Berry had no history of violence and Mejia, Larson, and Freyre were aware of Berry's ill health and sick leave when being arrested. During the arrest, Detective Mejia, Larson, and Freyre roughly twisted Berry's arm, pushed his head into a wall, and swung him around by his twisted arm before being thrown into a chair. Mejia, Larson, and Freyre also lifted his arms in the air forcing his head and body forward while both arms and wrists were twisted and cuffs were placed on him. After the arrest, the defendant transfit issued a press release that plaintiff described as libelous and contained false accusations.
