The two officers transported plaintiff to the 77th Precinct without incident. Once the plaintiff arrived at the precinct Officer Christopher Hassan allowed an officer Nicholas Smith (Shield #23398) to process plaintiff's arrest paperwork. At the time, Officer Hassan, his partner and Officer Smith took plaintiff before a desk sergeant and searched the plaintiff. After the search, the three officers escorted plaintiff to a room in the back of the precinct on the first floor, an area where suspects are brought in, fingerprinted and their pictures taken. Plaintiff remained in handcuffs at that time. Plaintiff entered the room cuffed to the back with officers, Hassan and Smith holding plaintiff by each arm. Hassan’s partner remained outside of the room. Once inside Smith and Hassan took the cuffs off one of plaintiff’s hands and extended plaintiff‘s arms outward. Hassan, while holding plaintiff’s arm ordered plaintiff to “take off [his] jacket.” Plaintiff responded “how I am I gonna take off my jacket when you two (Hassan and Smith) are holding my arms.” Suddenly, Hassan and Smith slammed plaintiff’s face onto a desk several times. An officer who appeared to be of Asian origin (John Doe # 1) jumped onto the back of plaintiff’s neck as he was face first on the desk and applied pressure as Hassan and Smith kicked and punched plaintiff. The officers re-cuffed plaintiff very tightly. They twisted plaintiff’s wrist, elbows and shoulders and shove plaintiff head first into a series of metal bars connected to the bullpen. Plaintiff began to bleed from his wounds and asked for medical attention but was denied medical attention for hours. On October 14, 2013 Mr. Milton was arranged in Kings County where he was made to withstand the pain of his injuries until he pleaded for medical attention in tears. Mr. Milton was then taken to Kings County Hospital for medical treatment. Mr. Milton made several appearances at the Kings County Criminal Court until the matter was finally dismissed and sealed. Plaintiff explained to the officers that his brother was chronically ill and could not tolerate this trauma and that they could not enter without permission or a warrant. The officers claimed that they received a call from within the building, but no one in the building called the police. Plaintiff demanded to see the officers’ shield numbers, but the officers refused. Several officers, including Huda, Hassan, and Bertram, then grabbed Plaintiff, threw him against the wall, and used excessive force to drag Plaintiff from his residence. Once outside, the officers threw him against the police car. The officers had placed handcuffs on Plaintiff excessively tightly, and they refused to loosen them despite Plaintiff’s pleas. The officers arrested Plaintiff without probable cause. Plaintiff was taken to a police precinct and placed in a holding cell. At the precinct, Defendants falsely informed employees of the Kings County District Attorney’s Office that they had observed Plaintiff commit crimes and/or offenses. Plaintiff was transported to Brooklyn Central Booking. Defendant officers then falsely informed Kings County DA that they observed Plaintiff with marijuana, and defendant officers falsified documents to support their false claim and unlawful arrest. \n\nOn May 4, 2012 at approximately 10:00 AM, Plaintiff was taking with his friend near the doorway of a friend's apartment at 655 Sterling Street in Brooklyn. Several NYPD officers including Defendant Police Officer Claribel Aquino pushed through the door and questioned Plaintiff, asking for identification. Plaintiff did not have his ID on him, and officers responded by saying they were going to arrest him and take him to the precinct for questioning. Again, defendant officers told Plaintiff that if he told them information about activity in the neighborhood, they would drop the charges and let him go.
