Nissanoff was accused of theft of a diamond, but not only did Nissanoff not steal the diamond, but also there was no sufficient evidence to prove officers' claim. The evidence that the officers relied on was uncorroborated and did not prove any theft. Nissanoff was arrested publicly in front of his place of business and was seized his customers' properties - thereby preventing his customers from getting back their properties for about a year. This seizure of properties damaged his business relationship and was humiliating to him both personally and professionally, and officers' negligent conducts inflicted emotional distress. Furthermore, Nissanoff was pinned against the wall while being tightly handcuffed behind his back. Due to his medical history with his elbow, he suffered great pain and requested to be handcuffed differently, but was refused. In the meantime, the officers continued to intentionally and maliciously prosecute him despite lack of probable cause and they failed to intervene each other to prevent such a misconduct. While being detained Nissanoff received improper medical care which almost led to his death.
