The NYPD pointed a firearm at Paul Colon and then immediately placed him under arrest.  Shortly thereafter, the NYPD struck Gene Colon in the face multiple times, threw him to the ground, and then immediately placed him under arrest.  Plaintiffs were subsequently transported to a nearby police precinct and charged with resisting arrest, obstructing government, and harassment.  In connection with Plaintiffs' arrests, the NYPD filled out false and/or misleading police reports stating that Plaintiffs approached the patrol car where Defendant Lozada was sitting, pulled on the window and door handle of the vehicle, and resisted arrest.  Defendants are also alleged to have falsified evidence and withheld exculpatory evidence in the criminal proceedings against Plaintiffs.  Paul Colon spent approximately 8 days in custody before all charges against him were dismissed, and Gene Colon spent approximately 48 hours in custody before all charges against him were dismissed.
