MARTUCCI, QUINTO, JOHN, or JANE DOE 1-10 approached the Plaintiff in the vicinity of inside the building located at 2575 Coney Island while the Plaintiff was lawfully present. P.O. MARTUCCI, QUINTO, JOHN, or JANE DOE 1-10 falsely allege that Plaintiff possessed a stolen vehicle and accused Plaintiff of a criminal offense. Then, P.O. MARTUCCI, QUINTO, JOHN, or JANE DOE 1-10 forcibly affixed metal handcuffs to his wrists in an excessively tight fashion. Due to P.O.’s wrong information, Plaintiff was then illegally detained in a dank and dirty cell for approximately 12 hours before being released. After plaintiff was falsely told by officers that recording was not allowed, plaintiff complied and attempted to leave the precinct. Nonetheless, plaintiff was tackled, handcuffed, and held face down while officers punched him in the back. The officers then shackled plaintiff's feet and stood on the shackles for an extended period of time, causing him extreme pain. Other officers who witnessed the ordeal laughed at plaintiff instead of intervening. Plaintiff was then taken to the hospital and diagnosed with a fracture, but when the police officers took him back to the precinct, they left the crutches at the hospital, in disregard of plaintiff's need for them. P.O Martucci later manufactured false evidence which was conveyed to the District Attorney’s office.
