Farghaly was walking down the block toward the taxi stand where his taxi was lawfully parked. Agent Marion Mitchell had placed a traffic violation summons upon Farghaly's vehicle. Farghaly asked why he received the violation, Agent Mitchell said \"because I feel like it,\" Farghaly expressed that this was unfair, and Agent Mitchell said \"Get the fuck out of my face before I punch you in your face!\" Farghaly said \"show me how you do it\" and Agent Micthell struck Farghaly in the face causing Farghaly's body to come into contact with the top of the front hood of his vehicle, rolling off to hit the ground. Agent Mitchell struck Farghaly with his official walkie-talkie. Farghaly called 911 and demanded Agent Mitchell stay at the scene, Agent Mitchell began to walk away. Farghaly tried to get Agent Mitchell to stay but Agent Mitchell pushed, shoved, and tussled Farghaly and walked away from the scene. Then NYPD officer Alvin Soto arrived and after Farghaly's explanation, Officer Soto disregarded and dismissed Farghaly's account of the occurrence without any proper investigation.
