The incident arose when Mr. Noel and his wife were exiting Coney Island beach. There the two observed a police officer with a man in custody (James M. Farah). The officer was followed by a second officer who was riding a motor scooter on the sidewalk. Upon observing that the officer was riding a motorized scooter on the sidewalk, Mr. Noel commented to his wife that the officer would not get a ticket – Officer Farah told Mr. Noel to “shut up,” to which Mr. Noel responded by saying words to the effect of: “with all due respect, I was not talking to you”. Officer Farah subsequently ordered Mr. Noel to turn around and handcuffed him – Officer Farah then called for a police car and ordered Mr. Noel to enter it. Mr. Noel was unable to get into the car on his own while handcuffed due to having a prosthetic leg, and this led to Officer Farah and another officer manhandling Mr. Noel, forcing him into the car. Mr. Noel was injured as a result of this and suffered damage to his prothesis, to the point that it had to be replaced. Mr. Noel was subsequently brought to the 60th Precinct and placed in a filthy holding cell – his handcuffs were not removed. Mr. Noel remained at the 60th Precinct until approximately 10:30 am the following day, at which time he was transported in handcuffs to Brooklyn Central Holding.  Mr. Noel did not get to see a judge until 4:00 pm, at which time he was released. Officer Farah concocted charges against Mr. Noel that had no basis in facts – Mr. Noel was charged with obstructing governmental administration, two counts of disorderly conduct, causing a crowd to gather and causing Officer Farah to fear for his safety, and for going limp upon being handcuffed. As one or more NYPD supervisors had to approve the arrest and detention of Mr. Noel, and the false charges against him, Officer Farah must have obtained approval(s) from his supervisor(s). On January 23, 2013, the charges against Mr. Noel were dismissed.
