Plaintiff suffered substantial injury to his left shoulder, right wrist, back, head, and face. Plaintiff was handcuffed and arrested, even though he had not acted in a threatening or violent manner or engaged in any criminal activity during or before his arrest. Plaintiff was take to the 48 Precinct, where he was kept for several hours before being transported to a hospital for the numerous injuries sustained during his arrest. Plaintiff was arraigned at the hospital and charged with Attempted Murder and Criminal Possession of a Weapon. Plaintiff was then transported to a different hospital and was placed under the custody of the Department of Corrections. He remained in custody until he posted bail on July 11, 2019. Plaintiff's case was ultimately dismissed after multiple post-bail court appearances. He continues to suffer from the injuries sustained during his arrest and fears for his physical safety when he sees members of the police department. Defendant police officers, without any search warrant, illegally broke the door and entered plaintiff's bedroom, violently grabbing plaintiff and yanking her from the bed. Plaintiff's arms were violently twisted and she was handcuffed in an excessively tight fashion. It was alleged that contrabands were placed in a closet in the apartment by the two other individuals the night before, but plaintiff had no part in it and did not possess any contraband. Plaintiff was subsequently charged with possessing drugs and firearms, but all charged were eventually terminated in her favor. Two officers, including Defendant Ezequiel Martinez, stopped Plaintiff as he exited the building to ask why he had been in the apartment building. Without any attempt to verify his explanation, the officers arrested Plaintiff and took him to the 40th Precinct, where he was strip searched and held for almost 48 hours in custody until he was released without charges. Defendant officers also asked a white man what he was doing in the building, when he said he lived there the officers let him go without verifying.\n\nOn March 8, 2011 Plaintiff Kevin Hill was at 320 East 156th St to visit another friend, when he was stopped by two officers, including Defendant Oliver Castillo. Again the officers asked why he was there and when he told them he was there to see a friend, they got into the elevator with him and put him in excessively tight handcuffs. They did not attempt to verify Plaintiff's explanation, instead they took him to PSA 7 Precinct, then to Central booking and charged him with criminal trespass in the second and third degree and trespass. He was held for 24 hours.
