On September 5, 2012, Plaintiff was arrested based on his ex-girlfriend's allegations and charged with aggravated harassment. On or about September 21, 2012, Plaintiff received a telephone call from Detective Mark Martin, who told Plaintiff about the ex-girlfriend's August 31 allegations and asked him to turn himself in to the 48th Precinct to be arrested for aggravated harassment. Plaintiff told Detective Martin that he had already been arrested for and was being prosecuted based on his ex-girlfriend's allegations. Detective Martin advised Plaintiff that he was not going to look into the matter and expected Plaintiff to turn himself in. Plaintiff agreed to meet police officers at Plaintiff's home in the Bronx, even though he knew they had no legal authority to re-arrest him, because he did not want to anger police or escalate the situation and risk angering the officers, who might fraudulently accuse Plaintiff of additional crimes. Detective Martin, Sergeant Carl Root, and two John Doe police officers handcuffed Plaintiff and transported him to the 48th Precinct, where he was detained for many hours.
