Abdi and Ali verbally then physically attacked Plaintiff, causing significant physical injuries. At some point Plaintiff left the deli. Abdi and Ali called the police, fabricating that Plaintiff had stolen property and threatened Abdi and Ali with a fist and razor. Based on these representations, POs Johnny Osario and John Latanzio arrived on scene. PO Osario arrived in his police vehicle and used it as a weapon to hit Plaintiff, who was at that time running on the sidewalk. While Plaintiff lay injured on the ground, PO Latanzio discharged his taser on Plaintiff. PO Latanzio later falsely reported Plaintiff threw a bicycle at him, causing PO Latanzio injury. Plaintiff was charged with larceny, assault, harassment, menacing, and criminal possession of a weapon. Though these charges were ultimately dropped, they caused Plaintiff mental anguish, trauma, and suffering.
