Defendant Police Officers Puccia and Tarlantino instructed everyone to get out of the car. Plaintiff got out of the car and was immediately handcuffed and the cuffs were very tight. Defendant Police Officers Stanley and Rivera both arrived on the scene wearing plain clothes. Plaintiff pleaded for Defendants to loosen his cuffs, but they refused. Officers told Defendant Rivera that they found nothing and Defendant Rivera then proceeded to search Plaintiff in a way that hurt his hands, fingers, and legs. Defendant Rivera even pulled Plaintiff's shirt over his head and officers began hitting him in the back of his head and neck. Defendants Rivera, Stanley, and Tarlantino continued to assault and beat the Plaintiff. He was in so much pain that he almost passed out and he then soiled himself. Plaintiff took off his clothes down to his underwear and was taken to the back cell and his clothes were thrown in the toilet. Defendant Rivera came into the cell and instructed Plaintiff to lift his hands above his head as high as he could, and Plaintiff informed him that he couldn't because of the pain. Defendant replied that if he did not lift his hands over his head, then Defendant would deem him to be retaliating and would have to use force to subdue him. So Plaintiff lifted his hands as high as he could, despite the pain. Plaintiff was then left in the cell for approximately seven hours, and was not given a change of clothes or anything to clean himself with.\n\nAt approximately 9:30 p.m., Plaintiff's wife came to the precinct and gave him a change of clothes. Plaintiff was held in the cell for approximately six more hours and at approximately 3:00 a.m. he was taken to Central Bookings, where he was held until approximately 4:00 p.m. on January 10, 2013. Plaintiff was arraigned on charges of possession of marijuana and then released on his own recognizance. However, Plaintiff used the straw to clean his teeth, and later an NYPD substance analysis report confirmed there was no controlled substance residue on it.  Mr. Myers was also arrested for having a straw with cocaine residue on it, and an NYPD substance analysis report confirmed that there were trace amounts of heroin on the straw and Mr. Myers subsequently pled guilty to possession of a controlled substance. Plaintiff was placed under arrest and transported to the 75th Precinct and then to Central Booking, where he was released approximately twenty hours after his arrest.
