Defendant Officer Sebastian Hernandez punched Plaintiff Jaquez repeatedly in the back while he was restrained. Plaintiff Jaquez was later falsely charged with disorderly conduct via failure to disperse (despite never being asked to disperse),  detained for 12 hours, and eventually had the charges dropped. \n\nWhile Plaintiff Jaquez was being arrested and beated, Plaintiff Jenise Ramirez, Plaintiff Jaquez’s partner, filmed the incident. Despite being visibly pregnant, Defendant Officer Krishna Ghale shoved Plaintiff Ramirez forcefully, causing her to strike a fence and experience vaginal bleeding. Musanti kicked Plaintiff twice in the back of his legs. Plaintiff turned around and asked Musanit if she had kicked him, to which Musanti responded yes and told him to get out of her way, threatening to kick him again. Plaintiff tried to disengage from the situation and continued walking toward the entrance of his office building, but Musanti stood in his path and continue to yell at him. Plaintiff put his hands up and lightly pushed Musanti out of his way. Musanti then attacked Plaintiff: kicking, scratching, slapping, and punching at Plaintiff's face, body, groin, and legs. Plaintiff tried to defend himself by deflecting and shielding himself, but did not hit Musanti back. Plaintiff grabbed her by the coat and pulled her to the ground to immobilize her. Then, a securty guard from Plaintiff's office grabbed Plaintiff to separate him from Musanti. Musanti then resumed attacking Plaintiff until the security guard released Plaintiff who then went to his office on the sixth floor. Several police officers, including Officer Manetta, entered Plaintiff's place of employment after being called to the scene by Musanti, who wished to press charges against him for assault. Plaintiff explained what happened and expressed that he wanted to press charges against Musanti, but Officer Manetta refused to take his complaint. Musanti is a Caucasian and female, and Plaintiff is African-American and male. Officer Manetta then arrested and handcuffed Plaintiff and took him to the police car outside of the building. Plaintiff's boss arrived on the scene while Plaintiff was in the car, and one of the officers asked his boss whether he was going to fire Plaintiff. Plaintiff was then taken to the 14th Precinct and fingerprinted and photographed. While there, Officer Manetta told him that \"more than likely your case will be dismissed in court.\" Plaintiff was issued a desk appearance ticket by Officer Manetta with a charge of assault in the third degree. Plaintiff appeared in court for his arraignment on January 6, 2014 and pleaded not guilty to all charges. After arraignment, Plaintiff was required to return to court on at least six occasions in 2014: February 13, April 22, May 29, August 4, September 22, and October 2.
