On or about December 18, 2013, Woodrow Ward informed the officers that he saw Plaintiff shoot the victim. However, Mr. Ward identified Plaintiff only after Mr. Ward was arrested and was offered a favorable plea deal and $2,000 in exchange for his testimony. Officer Costello and the other unknown officers also spoke with an eye witness to the shooting who knows the Plaintiff and confirmed that Plaintiff was not the shooter. That same witness told the officers the name of a different person that they believed to be the shooter. Despite that witness' statement conflicting with Mr. Ward's statement, the officers deviated from acceptable police activity and failed to make further inquiry, and arrested Plaintiff for murder on or about December 20, 2013. On or about December 21, 2013, a grand jury indicted Plaintiff for murder. The grand jury was not informed about the money and plea deal Mr. Ward was offered nor the eye witness' statement that the Plaintiff was not the shooter. Plaintiff remained incarcerated until on or about May 6, 2015. \n\nOn or about May 5, 2015, Mr. Ward gave a sworn statement to the DA that he did not see Plaintiff shoot the victim. The charges against the Plaintiff were dismissed on either December 3 or 6, 2015.
