Some of the tenants approached him with weapons and chased him off. Plaintiff went to the 79th Precinct to report the tenants' actions. When he arrived at the precinct, he told defendants—NYPD Officer Driscoll and the 10 John Doe Defendants—that he was a licensed process server and had been chased away while attempting to serve eviction notices. The NYPD defendants put him in handcuffs, searched him without probable cause or reasonable suspicion, and took him into custody within the 79th Precinct. Plaintiff was detained for approximately 24 hours before he was arraignment.\n\nOfficers Driscoll and the John Doe officers then submitted false reports and statements to the Kings County DA. These reports omitted plaintiff's role as a process server and statements from the landlord who hired him, and caused plaintiff to be charged with criminal mischief. Each officer failed to intervene in the other officers' filing of false statements.
