Defendant officers knocked on Plaintiff's door and accused him of a criminal offense. Defendant officers grabbed Plaintiff about his head and body in an aggressive fashion and searched his person by rifling hands in and out of his clothing and personal belongings. No contraband was found. Defendant officers nonetheless violently contorted Plaintiff's arms and wrists behind his back and applied excessively tightened handcuffs, causing significant pain and discomfort. Despite repeated pleas from Plaintiff, Defendant officers would not loosen the handcuffs. Plaintiff was transported to the precinct where he was fingerprinted, photographed, strip-searched with attendant cavity inspection, questioned his pedigree, and illegally interrogated him without presence of counsel and without being Mirandized. Defendant Officers, wearing plain clothes but identifying themselves as NYPD officers, informed Plaintiff they were there to pick him up on an alleged criminal burglary charge and they proceeded to begin a pat-down search. Finding no contraband, officers escorted Plaintiff downstairs and placed him in handcuffs. Defendants transported Plaintiff to the 41st precinct, where he was interrogated in a private room. A Defendant officer told Plaintiff they arrested him for a burglary that occurred at a bodega in the Bronx one week prior and they showed Plaintiff a photo of the suspect, who was clearly not him. Defendant Detective Kaloudakis claimed he personally recognized the photo from video surveillance as matching Plaintiff.  Then, Plaintiff was taken to Central Booking and detained overnight. On April 24, Plaintiff was arraigned and released on his own recognizance after 40 hours in custody. The Bronx DA tested DNA left at the bodega crime scene and Plaintiff voluntarily gave his DNA.
