POs Kellie Hughes and Elmore McDonald arrived and conversed at length with the employee, instructing him how to fill out the signed paper so it properly alleged a criminal complaint. Plaintiff attempted to explain the misunderstanding but POs did not listen to him. After instructing the employee on how to properly allege a criminal complaint, POs arrested Plaintiff and charged him with Petit Larceny and possession of stolen property. Plaintiff was incarcerated for approximately 16 hours. Sgt. David Furman, PO Hughes, and PO McDonald, commenced a malicious prosecution against Plaintiff, compelling Plaintiff to return to court multiple times to defend against the false charges until all charges were dismissed and sealed on April 21, 2019.
