The Defendants—NYPD Police Officers Daniel Mizvesky, Damany Ferril, John, or Jane Doe 1-10—abruptly entered Plaintiff’s mother’s apartment with consent, a search warrant, legal authority, or any indication that Plaintiff did any illegal acts. After entering the apartment, the Defendants woke Plaintiff up by shining bright lights on his face and placing their shields and weapons close to Plaintiff’s body. Without any legal justification or probable cause, the Defendants grabbed the plaintiff’s body, and extremities, violently contorted the plaintiff’s arms behind his back, and then affixed metal handcuffs to his wrists in an excessively tight fashion while he was dressed in boxers. The Defendants then arrested the Plaintiff despite there being no probable cause, search warrant, arrest warrant, legal authority, or indication that the Plaintiff committed any crimes or had any violation of the law. Though the Plaintiff requested that the Defendants loosen his handcuffs, the Defendants ignored the Plaintiff’s pleas and then sadistically and intentionally squeezed the handcuffs further to inflict more pain on the Plaintiff. Plaintiff then suffered contusions, swelling, and loss of feeling in his wrists, hands, and arms. \n\nAfter moving the Plaintiff from the bedroom to the living room of his mother’s apartment, the Defendants illegally interrogated the Plaintiff, which led the Plaintiff to ask Defendants for a search warrant. Defendants then purported to the Plaintiff a piece of paper they stated was a valid search warrant but would not show the Plaintiff the paper. Defendants then proceeded to illegally search and seize the apartment but could not find anything illegal. Defendants then transported the Plaintiff against his will to the 79th precinct where he was criminally processed, invasively searched, subjected to illegal interrogation tactics, and maliciously prosecuted by the Defendants who gave false information to the District Attorney's office to charge the Plaintiff. Plaintiff then remained in prison until September 3, 2020, at noon and was charged with six different crimes despite a lack of probable cause or any evidence indicating he committed a crime. Ultimately, Plaintiff’s charges were dismissed on November 5, 2020.
