Defendants Detective Arienda and NYPD officers (John Doe #1-10) burst into the apartment without prior warning. Defendants Arienda and the officers had guns drawn, pointed at Plaintiffs, and broke down the door to the apartment with a sledgehammer. Defendants Arienda and the other police officers then arrested and detained all Plaintiffs and handcuffed them together except for the five-year-old infant Plaintiff, JAIDEN DAVIS. Plaintiff, JANTAE DAVIS, was pulled naked out of a shower by arresting officers and handcuffed. The officers searched for guns, drugs, and an individual, and then they realized they had broken into the wrong apartment. However, they later claimed to have uncovered residue of marihuana on a window sill outside the apartment. Defendants Arienda and the officers served Plaintiff RALPHELL DAVIS with a Desk Appearance Ticket for possession of marijuana. However, no charges were lodged or filed with the court, and Defendants or a prosecutor refused to proceed with the criminal case.
