The only direct evidence that connected Plaintiff to the crimes he was charged were the highly suspect identifications of four witnesses, each of whom testified under a grant of immunity, had every reason to curry favor with the police, and whose identifications were conducted under suggestive procedures by Officer DeLoren, who was well aware that he was acting in violation of Plaintiff's rights. More specifically, Detective DeLoren potentially biased the victims' identifications by, for example, allowing them to talk among themselves about Plaintiff's identification and allowing them to view his photos on Facebook. The jury, primarily relying on the false identifications, found Plaintiff guilty. As a result of the false conviction, the innocent Plaintiff was sentenced to 10 years in prison, followed by 3 years of supervised release. Plaintiff spent six years in prison. On April 15, 2020, the 2nd Circuit reversed and vacated Plaintiff's conviction, specifically citing to the improper eyewitness identifications obtained by Officer DeLoren as an egregiously obtained witness identification.
