When Plaintiff legally went through the turnstyle, Defendant Henriquez stopped Plaintiff and asked for identification. Upon running the identification, Henriquez informed Plaintiff that he had an outstanding warrant stemming from a 1982 summons. Believing that he had previously addressed that summons, Plaintiff stated that there must be an error, but Defendant Henriquez informed that he had to arrest and handcuff Plaintiff. Plaintiff was handcuffed and led out of the train station to an awaiting police van near the Burnside Avenue train station. He stumbled when stepping on the van and twisted his right knee causing severe pain and discomfort. Additionally, Defendant Henriquez failed to lock the handcuff so that when Plaintiff was transported, the aforementioned handcuffs continued to tighten around the wrists of Plaintiff with each bump and pothole the police van hit, causing severe pain and discomfort. Before seeing the judge, the clerk confirmed that Plaintiff was correct and that the 1982 matter at issue was resolved and no warrant existed.
