Both Plaintiffs explained they were not fighting and neither assaulted the other in any way. While explaining, Plaintiff Cortes spoke in a loud voice because he is partially deaf. A PO mistook the tone as aggression, spit on Plaintiff Cortes twice, then grabbed Plaintiff Cortes and shoved him into a steel gate. Plaintiff Cortes has had several back surgeries over the years and walks with a cane, which POs must have noticed. In order to prevent himself from falling and seriously injuring himself, Plaintiff Cortes grabbed the PO's bulletproof vest. However, his weight pulled the office down on top of him. As a result, the other POs beat Plaintiff Cortes while he was on the ground and while one of them held his legs, intentionally kneeing and kicking him for approximately 20 minutes while Plaintiff Ruiz was held back by other POs. \n\nPlaintiff Cortes was arrested for obstruction and resisting, and was incarcerated for approximately 3 days. Plaintiff suffered 3 seizures while in custody and was taken to the hospital for medical attention. Plaintiff Cortes was released on July 1, 2014 and thereafter compelled to attend court three times to defend against the malicious prosecution. Plaintiff Cortes's case was dismissed on March 3, 2015. Plaintiff Ruiz was incarcerated for approximately 18 hours and compelled to attend court 3 times to defend against her malicious prosecution until her case was dismissed on October 1, 2014. Plaintiff Cortes suffered injuries to his chest, mouth, wrists, legs, arms, elbow, head, and is still suffering from the injuries caused by POs.
