A family member with a history of violence, Ansila E. Bryant, came to her home, attempted to enter her home, and forcibly pushed the Plaintiff. The Plaintiff punched Bryant in response and went to the precinct to report the incident. At the precinct, the Plaintiff met with an NYPD officer who refused to file a report. The NYPD officer contacted someone via department radio and told the Plaintiff to stay at the precinct. The Plaintiff told the NYPD officer that she had surveillance camera footage of the incident.\n\nWhile the Plaintiff was at the precinct, Defendant NYPD officers Richard Powers and Robert Emmanuel responded to Bryant's 911 call. Powers and Emmanuel accepted Bryant's account of the incident.\n\nThe Plaintiff alleges that multiple NYPD officers failed to inform Powers and Emmanuel about the surveillance camera footage. Powers and Emmanuel failed to interview the Plaintiff regarding the incident. The NYPD officers failed to record that the Plaintiff went to the precinct to report the incident.\n\nOn July 1, 2022, the Plaintiff returned to the precinct to try to report the assault again. Defendant NYPD officer Claudia Pinzon prepared a domestic incident report, misstating the circumstances of the incident and listing it as Harassment. Pinzon failed to notify Defendant NYPD officers Derby St. Fort, Wanyory Garcia, Philip Disanto, Stefan Olynyk, and other unknown NYPD Officers regarding Plaintiff's claims. The NYPD Officers did not properly review the claim under their internal document review process. Disanto, Garcia, and an unknown NYPD officer entered an Active Investigation Card for Plaintiff's arrest.\n\nOn July 4, 2022, the Plaintiff went to the precinct to follow up on the complaint she filed. Defendant NYPD officer Yulia Braginsky informed her that there was a warrant for her arrest and arrested her. The Plaintiff informed Braginsky that there was surveillance footage that she was not the aggressor but Braginsky told her to tell the detective. \n\nOn December 8, 2022, the case was dismissed after the Plaintiff appeared in court several times and the surveillance footage was reviewed, showing the the Plaintiff was not the aggressor.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nyed.489846/gov.uscourts.nyed.489846.1.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/66631524/lara-v-the-city-of-new-york/"},{"name":"Hafif, Dibo vs Rabbi Eli J. Officer Parisi promised that him and his unit would arrest the rioters if they did not stop. The NYPD left 1 police car and the officers did not get out of their car. Once the officers left, the crowd grew to over 1,000 and they stayed until 2AM. On March 10, 2021, Hafif went to the NYPD 61st Precinct and was assured that anyone who was seen vandalizing at the riot that night would be arrested, this was specifically said by Officer Thomas Costarella and this promise was accompanied by Officer Costarella's personal phone number. During the riot later that night, Hafif called Officer Costarella over 20 times and every call was ignored. There were over 1,000 rioters who stayed until 2AM and a police report was not taken this night. On March 11, 2021, Hafif was arrested by NYPD members of the 61st Precinct. After Plaintiff's sister complained about the treatment of people in the crowd within earshot of NYPD officers from her doorway, Defendant Officers Lt. Bobo, Sgt. Musa, PO Aponte, and John Doe 1-4 rushed towards the home. Plaintiff was standing outside, and Lt. Bobo immediately grabbed him. Lt. Bobo, Sgt. Musa, PO Aponte, PO Chekalin, and John Doe 1-4 then forcefully threw Plaintiff on the ground, and then Sgt. Musa tased Plaintiff on the neck. Officers kept Plaintiff's arms pinned behind his back and brutally assaulted him. In an attempt to dissuade the officers, Plaintiff told the officers his job as an essential worker employed by the MTA as a bus driver, to which an unnamed defendant responded, \"I don't give a f--- who you are m-----------\" while his knee was placed on Plaintiff's neck. Plaintiff's head was then driven into the concrete, causing a gash above his eye. Defendants P.O. Jason L. Smith, P.O. Joseph C. Sicari, and other unidentified officers detained Spann at gunpoint, directing him to lie on the ground. While he complied, the officers proceeded to kick him, pin him down with their knees on his head, and tightly handcuff him, causing cuts and bruises to his wrists. Despite being handcuffed and subdued, the officers continued to physically assault him, resulting in serious injuries. Spann was also subjected to an illegal search, which yielded no contraband. He was later transported to the NYPD-73rd Precinct and detained before being released after prosecutors declined to press charges.\n\nA similar incident occurred on August 25, 2019, where Spann was again arrested without cause near the corner of Mother Gaston Boulevard and Sutter Avenue in Brooklyn. During this arrest, the officers kicked and tripped him, causing him to fall and sustain further injuries. Spann was once again tightly handcuffed and beaten by the officers, who ignored his requests for medical treatment.
