The Plaintiff was a transsexual and also homeless.  Shortly after the Plaintiff woke to the disturbance, Police Officers Jennifer Giannone, John/Jane Doe I-IV (\"Defendants\") arrived.\n\nThe Defendants approached Julien Texeria (\"Plaintiff\") with loaded firearms, outstretched limbs and other objects used to\nphysically seize, strike and restrain the Plaintiff. The Defendants wrongfully touched, grabbed, handcuffed, so tight that they caused the writsts to become blue and red, then seized the Plaintiff in an excessive manner. At no time did the Defendants have legal cause to grab, handcuff, seize or touch the Plaintiff, nor did the Plaintiff consent. \n\nThe Defendants acted without any warrant, order or other legal process and without any legal right, wrongfully and unlawfully arrested the Plaintiff, restrained him and his liberty and then took him into custody where he was intentionally confined by the Defendants for 28hrs. \n\nThe Plaintiff was then deliberately and maliciously prosecuted without probable cause. The Defendants failed to take reasonable steps to stop the prosecution and instead maliciously and deliberately provided false and/or incomplete information to the District Attorney's office to induce prosecution.
