Plaintiff was injured in the crash and exited the car. When Plaintiff noticed that the drivers of the other car were Defendant POs, Plaintiff placed his hands on his head. Defendant POs then accosted, seized, assaulted, and handcuffed Plaintiff. Defendant Paulino punched Plaintiff in the face 4-5 times. Defendant POs did not have probable cause to search or arrest Plaintiff. However, Plaintiff was transported to a precinct and then Central Booking, where he requested medical care.
