On November 11, 2013, shortly before 3:45pm, Plaintiff was with his friend going from Plaintiff's home at 40 Madison Street to play basketball at a park one block away. Near 46 Madison Street, Plaintiff's friend went across the street and left Plaintiff waiting for him on the sidewalk. Shortly thereafter Defendant NYPD Officer Arias approached Plaintiff and placed him under arrest for selling a controlled substance. On November 12, 2013, Plaintiff was charged in criminal court with two felonies (selling a controlled substance) and a misdemeanor (criminal facilitation). The felony complaint against Plaintiff states that Defendant Officer Arias was informed by the Defendant undercover NYPD officers (Shield #228 & Shield #276) that Defendant Officer Shield #276 purchased crack cocaine from Plaintiff's friend at 46 Madison Street. The complaint confirmed that Plaintiff was across the street at the time. Defendant Officer Shield #228 stated that he observed Plaintiff with his friend across the street prior to the alleged drug sale and saw Plaintiff make a \"cut signal\" toward his friend after he crossed the street. Plaintiff was released on his own recognizance. On November 15, 2013, Plaintiff testified before the Grand Jury, which returned a vote of no affirmative action. Plaintiff subsequently testified before the Grand Jury a second time, and on April 18, 2014, the Grand Jury voted to dismiss the felony counts in the indictment. On May 30, 2014, the remaining charges were dismissed.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nysd.442736/gov.uscourts.nysd.442736.1.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/13246363/espaillat-v-the-city-of-new-york/"},{"name":"Verdejo v. Plaintiff stopped at the corner of 110th Street and Lexington Avenue after an acquaintance, Eugene Diaz, called out to plaintiff and asked him for a cigarette. After plaintiff gave Diaz a cigarette, the two men had a conversation for approximately fifteen minutes. While plaintiff and Diaz were talking, a police van pulled up to the corner. The two officers in the van, Julio Meyreles and Edward Arias, stared at plaintiff and Diaz for approximately thirty seconds. One of the officers asked Diaz what was in his hand. Diaz showed the officers his hands and then placed some heroin that he had in his possession in his mouth. Plaintiff was unaware that Diaz was in possession of heroin. Officers Meyreles and Arias exited the van and walked over to plaintiff and Diaz. Officer Meyreles forcefully pulled plaintiff off of his bicycle, causing plaintiff to fall on the floor and land on his back. Plaintiff suffered pain and injury from Officer Meyreles' use of unnecessary force. Officer Meyreles grabbed plaintiff off the floor and shoved him hard against the police van. Officer Meyreles searched plaintiff. No drugs or illegal contraband were found on plaintiff. Officer Meyreles placed plaintiff under arrest and handcuffed plaintiff so tight that his hands became numb and stayed numb for several days. While Officer Meyreles was assaulting, searching and arresting plaintiff, Officer Arias searched Diaz and placed Diaz under arrest. On March 27, 2009, Officer Meyreles testified in a pre-trial suppression hearing that he observed plaintiff sell heroin to Eugene Diaz on July 5, 2008. On March 24, 2009, the case against plaintiff went to trial. On March 24, 2009, Officer Meyreles testified falsely at trial that he observed plaintiff sell heroin to Eugene Diaz on July 5, 2008. On March 24, 2009, Eugene Diaz testified at trial as a defense witness. Diaz testified that he did not purchase heroin from plaintiff on July 5,2008, but rather that he purchased heroin earlier in the day from someone else before he made contact with plaintiff. On March 26, 2009, the jury acquitted plaintiff of all charges and plaintiff was released from custody.","documents":[{"url":"https://www.documentcloud.org/documents/4918936-Verdejo-v-The-City-of-New-York-et-al"}],"docket":"09CV05975","officer_name":"Edward A.
