While he was on the roof, plaintiff observed defendants O'Brien on Urena on a roof of an adjacent building upon which both plaintiffs and defendants acknowledged each other's presence and waived at each other. After finishing the inspection, when arriving downstairs, plaintiff encountered same two defendants and when plaintiff started to walk towards the next building, defendant O'Brien came out of nowhere and jumped on plaintiff which led plaintiff shocked and wondering what he had done wrong. Defendant O'Brien grabbed plantiff and put him against a fence by the building and hand-cuffed plaintiff whereas defendant O'Brien refused to accept plaintiff's offer to show his identification and work papers. Instead, defendant O'Brief grabbed plantiff by his ankles and yanked him off the ground, forcing him to fall face first onto the pavement. Additional officers (defendants John and Jane Does) arrived on the scene and did nothing to stop O'Brien's actions, thereby failing to intervene to prevent further injuries. Defendant O'Brien directed defendant Urena to become the arresting officers who expressed respective reluctance, informing O'Brien that \"O'Brien was wrong and he always does this and makes me the AO.\" Plaintiff was charged on false charges of trespassing and spent over 24 hours in jail.
