After spending time with the friend, plaintiff’s boyfriend and the father of her children, Johnson, drove to the location to pick them up and drive them home. Upon arrival, Johnson legally parked his vehicle and waited for plaintiff and the children to join him. Defendant officers pulled up behind Johnson’s vehicle. Defendants exited their police vehicle and approached Johnson. Defendants interrogated Johnson asking several questions including, what he was doing at the location. Johnson calmly answered the questions and informed defendants he was waiting for his family. Defendants directed Johnson to hand over his state issued ID to them. Defendants directed Johnson to exit the vehicle so he could be handcuffed and he and his vehicle searched. As Johnson continued to inquire as to what was going on and the reason for his arrest, plaintiff and the children came down to join Johnson. Plaintiff opened the rear passenger door of the car for the children, and the children entered the back seat of the car. As plaintiff attempted to open the front passenger door to enter the car, defendants forcefully grabbed her by her wrist pulling her back. Defendants blocked plaintiff from opening the door or entering the car. Plaintiff inquired as to what was going on. Defendants ignored plaintiff. Plaintiff attempted to record the incident on her cell phone. Defendants forcefully snatched away the cell phone from plaintiff and seized her cell phone. Defendants subsequently removed the plaintiff’s children from the vehicle and illegally searched the vehicle damaging it in the process. Defendants’ illegal and warrantless search of the vehicle did not yield any contraband. Plaintiff was arrested and  charged with various crimes. Plaintiff was eventually released from her unlawful detention but was required to return to court to defend false charges against her. On April 28, 2021, the false charges against plaintiff were dismissed and sealed. The New York City Civilian Review Complaint Board reviewed defendant officers conduct and substantiated most of the allegations against them. Agho parked in the driveway of his home and the parties exited the vehicle. Plaintiff and the two females began to walk away from the vehicle and house, while Agho walked toward the front of his home. Defendant officers approached Agho and ordered him to stop, without reasonable suspicion or probable cause to believe Agho committed a crime or violated the law. Agho asked the officers why they were ordering him to stop but received no answer.\n\nAgho turned around with his back to the front door and was face to face with one of the Defendant officers. Without first saying anything, the officers assaulted and battered Agho by physically pushing him away from the other officers and into the front door, with an unreasonable amount of force. Fearful for what was occurring and not understanding why the Defendant officers were acting in this manner, Agho retreated inside of his home and closed the door behind him.\n\nPlaintiff had barely walked off of the property when the interaction began but witnessed the entire situation. Plaintiff returned to Agho’s home and walked up to the front porch and stood with the officers. Defendant officers attempted to open the metal gate that was locked which covered the front door to Agho’s home. Agho’s mother, the owner of the home, opened the front door to speak to the officers through the metal gate. At that point, Plaintiff attempted to leave because the atmosphere was becoming too heated and he thought it safer if he got off the porch. As Plaintiff attempted to leave the porch, one of the Defendant officers pushed him very forcefully on his back, causing him to fall down the stairs onto two police officers. The officers proceeded to grab Plaintiff and throw him over a gate located in front of the house. The Defendant officers punched Plaintiff in the face several times and pinned him to the ground.\n\nThe Defendant officers unlawfully handcuffed Plaintiff and falsely arrested him, without probable cause or any legal justification. Plaintiff was transported to the precinct where he was unlawfully searched, fingerprinted, photographed and detained in a holding cell for many hours.
