They charged Mr. Madison with violating vehicle traffic laws 'Obedience to Police officers and flagpersons' and 'Equipment'. Mr. Madison was not operating any motor vehicle on a public highway at the time, did not refuse to comply with any order and did not commit any offense.\n\nMr. Madison was visiting his brother when he realized that his right headlight had turned off on its own. He had experienced a similar problem a few days prior, and had managed to fix it by tapping on it. He stopped his vehicle at the gas station, exited the vehicle, opened the hood and proceeded to tap the headlight to turn it on. When he lifted his head, he realized he was surrounded by the Officers who asked \"what are you doing tonight, sir?\" He explained that he was going to his brother's house to watch a basketball game, and asked why the police were surrounding him. The Officers said \"have you been drinking tonight, sir?\" and then leaned in to smell his breath. They claimed he smelled like he had been drinking and asked him to go back to his vehicle and sit down. Mr. Madison asked again why he was surrounded and said he merely stopped to fix his headlight and hadn't done anything wrong. The Officers directed him to go back to his vehicle and sit down. They also made several derogatory remarks and called him a \"stinking, fucking arsehole\". Mr. Madison returned to sit in his vehicle, and called his wife. As he made the call, the Officers approached Mr. Madison and told him to hang up the telephone. He explained he was only calling his wife, but they repeated that he needed to hand up immediately. He hung up, and then the Officers opened the car door and arrested him. When Mr. Madison asked why he was being arrestede, he was told that they were going to administer a breathalyzer test and would release him if he wasn't drunk. He was taken to the 113th Precinct because the Officers said they did not have a tester of breathalyzer with them. They tightly handcuffed Mr. Madison, with his arms behind his back. They then twisted his arms and forcibly shoved him into their police vehicle. They then performed an illegal search of his vehicle, and then impounded it. \n\nAt the 113th Precinct, the Officers informed Mr. Madison that they were unable to administer the breathalyzer there, and so transported him to the 112th Precinct. Upon arrival, they handcuffed Mr. Madison to a wall with his pants pulled down. Eventually, after a lengthy period, a highway patrol officer brought a tester or breathalyzer and administered a test. He noted that Mr. Madison scored or registered .000, and asked why Mr. Madison had been arrested. Mr. Madison was uncuffed and the highway patrol officer left. The Officers then tightly handcuffed Mr. Madison again, with his hands behind his back. They claimed that he did not get back into his vehicle fast enough when he was directed to at the scene. They then processed his arrest and detained him for a lengthy period of time. He was detained in an unkempt cell with poor sanitary conditions, no mattress and was forced to lie on a bare floor that was covered in urine and feces. He was eventually transported tho the Central Booking for arraignment. The Officers falsely stated to the prosecutors that Mr. Madison operated a motor vehicle with a broken headlight on a public highway at nighttime and refused to comply with a lawful order of the Officers. A prosecution was commenced against Mr. Madison. \n\nOn or about May 7, 2013, the false charges were summarily dismissed. \n\nThe Officers also caused damage to Mr. Madison's vehicle.
