Kravtchouk, for Driving While Intoxicated and while doing so refused the plaintiff's request for a sign language interpreter, which the plaintiff requires in order to effectively communicate. As a result of Officer Ramos's initial refusal to provide an interpreter, the plaintiff faced several additional incidents of discrimination based on his disability, the harm of which was compounded by retaliatory actions taken by Officer Ramos. First, at the initial arrest site, due to an inability to communicate, the plaintiff was not read his rights and he was not properly instructed on how to take a breath test, and thus the plaintiff refused to do so without an interpreter available. At the precinct, the plaintiff was left for hours without communication and not informed about his rights and availability of accommodations, such as a teletypewriter that is available at all precincts for hearing impaired persons to use to communicate. Still at the precinct, the plaintiff refused a breathalyzer test until an interpreter was provided, and the plaintiff was not informed about the fact that his driver's license would automatically be suspended if he refused the test. At this point, another officer, Officer Bangali, purported to act as a qualified ASL interpreter, despite his conflict of interest. Officer Bangali failed to adequately communicate information to the plaintiff and was not a sufficient interpreter. When the plaintiff refused to use the breathalyzer until a qualified interpreter was provided for him, the officers present, including Officer Bangali and Officer Ramos, falsely recorded it as a full refusal to take the breathalyzer test. Subsequently and after the plaintiff's initial release, the false report was filed in court, resulting in an automatic revocation of the plaintiff's driver's license.\n\nThe plaintiff was pressured to plead guilty to the initial DWI charges, which he refused to do. On May 27, 2015, approximately six months later and because plaintiff refused to plead guilty, Officer Ramos took it upon himself to look into plaintiff's driving record. This resulted in Officer Ramos erroneously arresting the plaintiff again, this time for falsely stating the plaintiff did not have a hearing impairment on the official driver's license application, although it was an error that resulted in such accusation. The arrest again led to the plaintiff being denied proper interpretation accommodations. The district attorney's office dropped some charges and reduced the initial charge against the plaintiff.
