Katherine Paez and five unnamed officers for a misdemeanor related to a September 2017 family dispute. The Plaintiff was 40 weeks pregnant and visibly so - her baby's due date was February 9. Officer Paez noted that the Plaintiff was nine months pregnant in her arrest log. For the entirety of the proceeding 30 hours of her detention, the Plaintiff was shackled using a combination of metal handcuffs at her wrists and ankles. At no point did the Plaintiff present as a threat to herself or others, or as a flight risk.  She was not offered food or water between 10:40AM and 7:40PM while she was held in a cell at the Precinct. At 7:40PM, the Plaintiff was experiencing contractions and was transported to hospital. The transporting officers, Officer \"John\" Swift and an unnamed NYPD officer, knew the Plaintiff was pregnant. The Plaintiff was kept in handcuffs during transportation and at the hospital while being examined by medical staff. Medical staff were concerned to learn that at 9:10PM, the Plaintiff had still not been given any food or water - hospital staff provided cheese and juice to the Plaintiff. When the contractions turned out to be Braxton-Hicks, the Plaintiff was transported back to the precinct in handcuffs at 9:25PM. The Plaintiff was then held in a cell until after midnight, when she was transported in handcuffs to Central Booking by two unnamed NYPD officers. Staff at Central Booking refused to process the Plaintiff, stating in sum and substance that \"Central Booking medical staff did not know how to deliver a baby and that [the Plaintiff] did not belong there. The same two unnamed NYPD officers then transported the Plaintiff back to the precinct in handcuffs, where she was placed in a cell. The Plaintiff again was not given any food or water. At 5:00AM the Plaintiff went into labour and was again transported to hospital in handcuffs. At the hospital, the Plaintiff was placed in a wheelchair by the same two unnamed NYPD officers and had her ankles shackled together. The Plaintiff ultimately gave birth in the early morning of February 8th. She was shackled during the entirety of her labor and after delivery - forced to hold her newborn and breastfeed her while handcuffed. Nurses and doctors vehemently protested this treatment throughout the ordeal. The Plaintiff was denied the presence of her partner and obstetrician during labor and delivery. The shackling of pregnant women during, before and after labor is dangerous for both infant and mother and has been barred in the State of New York since 2015 except \"in the most 'extraordinary' circumstances\" and is absolutely prohibited during labor, delivery or recovery.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nysd.506010/gov.uscourts.nysd.506010.1.0_2.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/8363617/doe-v-the-city-of-new-york/"}],"discipline":[{"disposition_date":"2021-06-01","case_no":"2021-23487","penalty":"Vacation days (5 days)","charges":[{"desc":"Discourtesy","disposition":"Guilty"}]}],"documents":[{"url":"https://www.documentcloud.org/documents/23945807-959268_04192023_2023018pdf","date":"2023-04-19T00:00:00.000Z","type":"trial-decision"},{"url":"https://www.documentcloud.org/documents/24441170-bronx-notified-officers-list-edited_redacted-redacted_redacted","type":"credibility-finding"},{"url":"https://www.documentcloud.org/documents/22086015-seh_959268","type":"employment-history"}],"payroll":{"salary":"118056","regular":"117261","overtime":"20377","other":"17711","total":"155348"},"id":"UCRH","url":"https://www.50-a.org/officer/UCRH"}
