The peaceful protest was organized after the deaths of Breonna Taylor and George Floyd in May 2020. Plaintiffs identified themselves as lawmakers to police officials before and during the protests. Shortly before 8 AM, the defendant NYPD officers broadcast a message to the protesters, telling them to disperse, despite having no legal basis for this order. Plaintiffs attempted to comply with these commands, but the NYPD officers \"kettled\" them in place, leaving them with nowhere to go.\n\nDefendant officers including Defendand Ciota then began to use their bicycles to assault Plaintiffs and other protestors, ramming their legs, abdomen, and pelvic area. The officers, including defendants Clinton, Perez, Kovalik, Bemudez, and Ciota then sprayed plaintiffs with pepper spray, blinding plaintiffs and knocking Plaintiff Richardson to the ground. No defendants attempted to give medical assistance to plaintiff Richardson. Meanwhile, defendants Taylor and Calderon arrested plaintiff Myrie without probable cause and refused to offer him medical assistance. Defendant officers Kovalik, Ciota, Bermudez, Ventrella, Olfano, and Kerr failed to intervene in the unlawful conduct against both plaintiffs. Plaintiff Myrie was eventually identified as an elected official and was released from custody. The plaintiffs then left the scene of the protest. Earlier that evening, Plaintiff had refused an acquaintance entry into his apartment to retrieve stored belongings because the acquaintance arrived intoxicated and was loudly banging on the door at 4:00 AM.
