When Mr. Westbrooks asked why he had been pulled over, the defendants refused to answer. At no point did the defendants observe Mr. Westbrooks committing any crime or offense. The defendants ordered Mr. Westbrooks out of his car and had him sit on the car's back bumper. Once he sat on the bumper, they yanked him violently up off the bumper and tightly handcuffed him. One defendant police officer kicked Mr. Westbrooks violently in the knee, causing him to fall, and then the defendants put him in a headlock. The defendants violently kicked him, including in his face, while he lay on the ground. Mr. Westbrooks had to be taken to the hospital due to his injuries. He was then taken to a police precinct, and then to booking, where he was arraigned and released on his own recognizance, after about eighteen hours in custody.
