Plaintiff was lawfully inside the apartment she sublets with her boyfriend at Doscher Street when her son informed her that there were police officers in the home. Plaintiff came downstairs and was immediately greeted by the sight of more\nthan five uniformed officers at the foot of the stairs. Once Plaintiff’s husband came downstairs, defendant officers lunged towards Plaintiff and her husband to try to arrest them. Plaintiff asked why she was being arrested, and instead of receiving an\nanswer, she was tasered. Plaintiff never received a warning or any other notice that she would be tasered. Plaintiff was tasered twice in the same spot above her left breast. Plaintiff was then handcuffed, searched, and placed into a police vehicle for\ntransport. Plaintiff was driven from her home to Brookdale University Hospital, where she was given a lidocaine injection and the taser prongs were removed from her skin in the early afternoon. Plaintiff was subsequently taken to the 75 Precinct where she was fingerprinted, photographed, and placed into a holding cell, and detained for several more hours. Sometime before midnight, Plaintiff was taken to Kings County Central Bookings,\n\nDuring this time, defendant Cumberbathwalt was provided false\nstatements to the DA. Defendant Cumberbatchwalt falsely\nclaimed that Plaintiff committed the crime of Obstructing Governmental Administration. Eventually, Plaintiff went before a Judge and was released on her own recognizance. Plaintiff spent approximately 20 hours in custody due to this arrest. However, at the request of the Kings County District Attorney’s Office, a\nprotective order was unlawfully issued against an unrelated party who was living in Plaintiff’s house at the time. As a result, Plaintiff was constructively evicted from her home and had to live in a shelter for 6 weeks. Due to the unlawful detention, Plaintiff missed 2 days of work. As a result of injuries due to being tased, Plaintiff lost her Job at UPS as she could no longer physically do the job. on June 23, 2021, all charges were dropped. As a result of the incident and emotional damage, Plaintiff continues to suffer from anxiety and can no longer trust the police.
